It is worth noting that in pure statistical terms, only approximately 1/3 of employees claims at the Tribunal succeed. This is not to say that a claim is not worth pursuing, but securing a settlement is often the best option for the employee, particularly as the time input and cost of employment tribunal claims, even where there is a no win, no fee agreement in place, often mean that it is in the employee’s interests to settle sooner rather than later.
